Art. 1 — Object and field of application

Le presenti Condizioni Generali di Vendita (CGV) disciplinano la vendita di prodotti alimentari e non alimentari di origine latinoamericana tramite il sito web www.tutiendalatina.it, gestito da D’FAMILIA MOSQUERA SRLS.

By purchasing from the site, the Client will be informed, understand and fully accept the present CGV. Le CGV si applicano a tutti gli acquisti effettuati da consumatori (persone fisiche che agiscono al di fuori di qualsiasi attività commerciale o professionale) ai sensi del D.Lgs. 206/2005 (Consumer Code).

Art. 2 — Prodotti and availability

The products offered for sale are described in the online catalog with indications of: name, main ingredients, country of origin, weight/quantity and price. The images are indicative. We serve the direction of modifying the assortment at any time.

Product availability is indicated in real time and is not guaranteed. In case of unavailability after confirming the order, the Customer will be contacted within 48 hours to agree on an alternative or receive the full refund.

Art. 3 — Prezzi

I prezzi esposti sul sito sono in Euro (€) IVA inclusa, salvo diversa indicazione. Non sono incluse le spese di spedizione, che vengono indicate in modo chiaro prima della conferma dell’ordine.

We will serve the direction of modification and prezzi at any time. The application price will be as indicated at the time of confirmation of the order.

Art. 4 — Ordering procedure and conclusion of the contract

Il contratto si conclude al momento in cui il Cliente riceve la conferma d’ordine via email. La procedura di acquisto si svolge come segue:

• Selecting products and adding to the carrello
• Insertion of shipping and payment data
• Reepilogo order and accettazione delle CGV
• Confirm and payment
• Email to confirm the order from us

Art. 5 — Payment

We accept the following payment methods:

• Letter of credit/debit (Visa, Mastercard)
• PayPal
• Bank bonus (the order is evaded when the payment is received)
• Contanti (only for ritual in business)

Online payments are protected by the SSL protocol. We do not retain the data of the credit card.

Art. 6 — Spedizione e consegna

The shipments have been processed for selected runs. The indicative time of the instructions is:

• 🇮🇹 Italia: 2–5 giorni lavorativi
• 🇪🇺 Europa: 5–10 giorni lavorativi

The instructions are indicative and non-guaranteed. In case of significant damage, the Client will be informed. The loss or damage of the products is transferred to the Customer at the time of delivery.

Ritiro in negozio: è disponibile il ritiro gratuito presso il nostro punto vendita di Via Bellinzona 177, 22100 Como, previo accordo telefonico.

Art. 7 — Prodotti Alimentari — Avvertenze

For food products, the information on allergens and ingredients must be reported on the label of the product. In case of allergy or food intolerance, we invite you to contact us first of all. [email protected].

Art. 9 — Legal guarantee of conformity

Tutti i prodotti sono coperti dalla garanzia legale di conformità prevista dagli artt. 128–135 del D.Lgs. 206/2005 per un periodo di 2 anni dalla consegna. In caso di prodotto difettoso o non conforme, il Cliente ha diritto a riparazione, sostituzione, riduzione del prezzo o risoluzione del contratto.

Art. 10 — Alternative Risoluzione delle controversie (ODR)

Art. 11 — Competent forum and applicable law

Le presenti CGV sono regolate dalla legge italiana. Per i consumatori, il foro competente è quello del luogo di residenza o domicilio del consumatore in Italia. Per i rapporti tra professionisti, il foro esclusivamente competente è quello di Como.
